Customer hereby releases Prescription-Air, Inc., its heirs and assigns, and its employees and officers (CONTRACTOR) from all claims, losses, damages, risks and causes of action (''Claims'') whether known or unknown, arising now or in the future regardless of date of discovery, or arising directly or indirectly from the Services, which result in any damages, injuries or Claims either to property or persons caused by Carbon Monoxide, Water, Soot, Mold or Mold related issues. Customer expressly assumes the risk of all damages, injuries, and claims to property or persons from Carbon Monoxide, Water, Soot, Mold and Mold related Claims resulting from the Services. This Agreement releases liability for any and all Claims of any kind whatsoever, including without limitation those at common law, in tort, contract, strict liability, or based upon statutes or rules and regulations, now existing or hereafter enacted. Customer shall indemnify, defend and hold Contractor harmless from and against any and all loss, liability claim, demand and expense, (including reasonable attorney fees) arising out of, or occasioned by, directly or indirectly, any and all Carbon Monoxide, Soot, Water, Mold and Mold related Claims resulting from the Services, even if caused by negligent acts of the Contractor. Customer agrees not to bring any action, whether by mediation, publication of any kind, arbitration or litigation against Contractor in connection with Carbon Monoxide, Water, Soot, Mold, or Mold related Claims. If any mediation, arbitration or litigation is commenced relating to Carbon Monoxide. Water, Soot, Mold, or Mold related Claims, Contractor shall be entitled to recover its reasonable attorney fees and costs from Customer. Customer represents and warrants to the Contractor that Customer is legally authorized to enter this Agreement, that Customer has read this Agreement fully and understands the terms and conditions of it, that Customer is of legal age and legally competent to execute this Agreement and has done so of his/her own free will and accord without reliance on any representation of any kind from the Contractor and has done so in consideration of the Services rendered by the Contractor. This Agreement shall be construed in accordance with the laws of the State of Ohio. Venue with respect to any action hereunder shall be in Hamilton County, Ohio.

We do not make outbound telemarketing calls outside of area codes 513 and 937.
